Intersection of personal and professional: Ethical and legal responsibilities with non-clients

Abstract

Issues which arise in counseling that warrant a mandatory report are fairly clear for counselors. While some states have mandatory requirements and some states have permissive requirements, all states but 4 (Nevada, North Carolina, North Dakota, and Maine) have some form of laws related to Tarasoff. All states have mandatory reporting of child abuse for mental health professionals.  However, the procedures are clear only for instances of when the counselor is working with the client and has direct knowledge and information of the situation.  The question arises – what is the responsibility when the counselor is aware of a situation, but has no direct knowledge of the situation or identifiable information?
